Petoodle Guarantee

Petoodle makes every reasonable effort ensure Animal Welfare Organizations (“Organization”) posting (“Posting”) on Petoodle are legitimate non-profit, 501(c)3, (c)4 entities. We do this by utilizing the services of GuideStar, a third-party (“Third-Party”) provider that verifies the current non-profit status of all Organizations at the time of their registration on the Petoodle Services (“Services”).  Please visit our Terms and Conditions for more information regarding Third-Party providers.  Fortunately, the vast majority of Postings are transparent, and funds are delivered and used for their intended purpose.  In the rare occasion an Organization may Misuse the Services, the Petoodle Guarantee (“Guarantee”) ensures that a donor’s (“Donor”) donation(s) are protected. In most cases alleged Misuse is not actual Misuse of the Services.  Our staff will work to resolve allegations quickly and fairly. ­

Petoodle Guarantee for Donors:

In order to be eligible for a refund, Donors must have made an online donation to a Posting shown our Services created by a participating Organization (Organization has created an account on and is using our Services).  For purposes of this Guarantee, Misuse (“Misuse”) shall be defined as:  Deliberately misleading or intentionally inaccurate content with regards to material fact(s) about the Organization, posting (“Posting”), or other relevant information which Petoodle determines is the principal reason upon which a reasonable Donor would depend on in making a contribution.

If Petoodle determines, in its sole discretion, that Misuse has occurred, it may reimburse Donor the amount of their donation(s) submitted through the Services (up to $500 per donor).  In the event said Donor has made donations to multiple Organizations, the reimbursement shall be limited to the amount donated to the offending Organization (up to $500).  Further, if Donor has made donations to multiple postings offered by a single Organization and Misuse has been confirmed only on a single Posting, the reimbursement shall be limited to the amount donated to the offending Posting (up to $500).  Additionally, any donations that have already been charged back (refunded) to a Donor shall not be eligible for any further restitution under this Guarantee.  All resolutions are decided by Petoodle in its sole discretion, and all determinations are final.

The following scenarios are excluded and do not give rise to benefits under this Guarantee:

• Seeking a refund for donations not transacted through the Petoodle Services;
• Wishing you had not made the donation;
• Disagreement on the use of Donation(s) by an Organization;
• Any personal reasons such as dislike of the Organization and/or someone associated with the Organization;
• Undelivered offers, promises, rewards, or promotions made or offered by any Organization as part of or included in their Postings;
• Donating to a Posting that has been removed for reasons other than Misuse;
• Disagreement with Petoodle for any reason; and/or
• Any reason not based on the documented, objectively held belief that a Misuse has occurred.

 

Requirements for Making a Claim:

The following criteria must be met in order to make a claim under this Policy:

• You did not in any way cause, contribute to, participate in, or induce the Misuse, whether directly or indirectly;
• You fully completed the claim form;
• You fully comply with all subsequent requests for information to facilitate the evaluation and processing of your claim. This will most likely include providing evidence to support your claim;
• You agree to fully cooperate with any investigation by Petoodle or a law enforcement authority;
• You agree to notify Petoodle if at any time you receive any communication or funds from the Organization; and 
• You agree that if you receive compensation for your claim from any person or entity other than Petoodle (for example, you receive a refund from the Organization through a court proceeding), you will return to Petoodle any such amount provided to you under this Guarantee.
• You still own the payment instrument you used to make the donation at issue and are authorized to accept a funds transfer back onto that payment instrument;
• You submitted your claim within 3 months of your donation date; and 
• You must not have already filed a chargeback nor received a refund for the same donation.

 

Filing a Claim:

To initiate a claim, please contact us at info@petoodle.com.  Please include the following in your request:

• Your full name
• Your phone number
• Your email address
• Animal Welfare Organization About Page URL and/or Posting URL
• A description of alleged Misuse with specific details including dates, infractions, pictures, third-party corroboration, police reports, etc.

 

Abusive Claims 

Abusive claims are prohibited and include but are not limited to the following:

• Filing excessive or duplicate claims;
• Misrepresenting facts or circumstances related to your claim, which may constitute fraud;
• Filing a chargeback after receiving a refund;
• Filing a claim under this Policy after filing a chargeback;
• Initiating a payment or refund request using a fraudulent payment instrument; or
• Any claim for a fundraiser where you participated in, caused or induced the Misuse, whether directly or indirectly.

We reserve the right to investigate anyone through any appropriate means and to take appropriate action against anyone who, in our sole and absolute discretion, violates any of the terms or the spirit of this Policy or the Terms and Conditions.

 

Petoodle Guarantee Policy for Organizations:

Notwithstanding the foregoing, if it is determined a refund is warranted, Petoodle may elect, in its sole discretion, to refund donors in whole or in part in lieu of providing you with payment.  Upon Petoodle’s request, you agree to return any contributed funds using the prescribed procedure at that time. All resolutions are decided by Petoodle in its sole discretion, and all of its determinations are final. 

Additional Clauses 

Entire Agreement and Definitions 

This Guarantee constitutes the entire and exclusive understanding and agreement between Petoodle and you regarding the subject matter herein and supersedes and replaces any and all prior oral or written understandings or agreements between Petoodle and you regarding your ability to claim or qualify for a refund or payment from Petoodle.

Modification or Termination 

Petoodle reserves the right to modify or terminate this Guarantee, at any time, in its sole discretion, and without prior notice. If we modify this Guarantee, we will continue to process all claims made prior to the effective date of the modification.

No Waiver

You agree that Petoodle’s decision to grant benefits under this Guarantee does not constitute a waiver of its right to decline refunds, payments, or other benefits in the future for any reason in its sole discretion.

No Assignment or Insurance or Warranty 

We encourage you to donate only to Organizations you know and trust. This Guarantee is not intended to constitute an offer to insure, does not constitute insurance or an insurance contract, does not take the place of insurance obtained or obtainable by you, and you have not paid any premium in respect of the Guarantee. The benefits provided under this Guarantee are not assignable or transferable by you. This Guarantee is not a warranty against fraud or any other Misuse of the Services.

Petoodle’s Terms and Conditions 

The terms of this Policy are hereby incorporated by reference into Petoodle’s Terms and Conditions. In the event of conflict, the Terms and Conditions will take precedence over the terms of this Guarantee.

Other Requirements 

You agree that a certain minimum donation amount may apply to qualify for benefits under this Guarantee, and that all donation payments remain final and will not be refunded unless Petoodle, in its sole discretion, agrees to issue a refund under the terms of this Guarantee.
